GoWoofer Pet Parent Terms of Service

1. Agreement & Acceptance

By clicking “Accept,” creating an account, booking a walk, or otherwise using the GoWoofer Inc. mobile or web application (the “Platform”), you (“Pet Parent”) agree to be bound by these Terms, the Privacy Policy, and any additional policies referenced herein. You represent that you are at least 18 years old and capable of entering into a binding contract.

2. The GoWoofer Platform; Intermediary Role

GoWoofer operates a technology platform connecting Pet Parents with independent dog walkers (“Walkers”) for on-demand or scheduled services. GoWoofer does not provide dog-walking services and does not employ Walkers. Each confirmed booking constitutes a direct contract between Pet Parent and Walker. GoWoofer facilitates scheduling, GPS tracking, communications, and payment processing only.

3. Account Registration & Security

You must create and maintain a valid account with accurate information. You are responsible for safeguarding login credentials and all activity under your account. GoWoofer may suspend or terminate accounts for fraud, safety issues, or Terms violations.

4. Bookings, Fees, and Payments

All bookings are made through the Platform. Prices shown include the Walker’s fee, applicable taxes, and GoWoofer’s service fee. You authorize GoWoofer or its payment processor (e.g., Stripe) to charge your payment method for all fees, tips, and applicable adjustments. All payments must be processed through the Platform. Direct payments to Walkers outside the Platform are prohibited. If a chargeback, reversal, or dispute occurs, GoWoofer may recover such amounts or offset future credits to your account. Refunds, if applicable, will be issued to the original payment method within 10 business days, subject to GoWoofer’s sole discretion.

5. Cancellations & Refunds

Cancellation windows and applicable fees are displayed before booking confirmation. Cancellations or no-shows outside permitted windows may result in fees up to the full walk cost. Refund eligibility is determined by GoWoofer and processed through the Platform. If a Walker cancels, GoWoofer may issue a refund or reassign a replacement Walker.

6. Pet Parent Responsibilities; Dog Health & Safety

You represent that your dog is healthy, vaccinated, licensed, and free from contagious diseases. You must disclose behavioral or medical conditions (aggression, anxiety, medication, injury, etc.) and provide safe, lawful walking equipment. You remain responsible for all acts or omissions of your dog, including damage to property or injury caused to others. You must ensure secure access for pick-up/drop-off locations and notify GoWoofer of any changes or incidents promptly. Pet Parents must comply with all local leash, animal control, and licensing laws in their jurisdiction (including New York City and California).

If your dog causes injury to a Walker, another person, another animal, or property, you are solely responsible for all resulting claims, damages, veterinary bills, and medical expenses. You agree to indemnify and hold harmless GoWoofer Inc. and the affected Walker against such losses, except where caused by gross negligence or willful misconduct of the Walker. You are encouraged to maintain homeowner’s, renter’s, or pet-liability insurance covering dog-related incidents.

7. No Off-Platform Solicitation

Pet Parents shall not solicit or engage Walkers for services outside the Platform for twelve (12) months following their last Platform interaction with that Walker. Circumvention may result in termination and legal remedies.

8. GPS Tracking, Photos & Communications

The Platform may collect GPS data, timestamps, and photos during walks for transparency and safety. You consent to receiving SMS, email, and push notifications related to your bookings. All communications must occur within the Platform for recordkeeping and dispute resolution.

9. Emergency & Veterinary Care Authorization

If your dog becomes ill or injured and you cannot be reached, you authorize GoWoofer and/or the Walker to obtain emergency veterinary care at your expense. You release GoWoofer and the Walker from liability for good-faith actions taken under such circumstances.

10. Walker Vetting & Disclaimers

Although GoWoofer may conduct background or identity checks, it does not guarantee the reliability, safety, or continued eligibility of any Walker. Walkers are independent third parties, not employees or agents of GoWoofer. The Platform and Services are provided “AS IS” and “AS AVAILABLE.” GoWoofer disclaims all warranties, express or implied, including merchantability, fitness for a purpose, and uninterrupted operation.

11. Risk Allocation; Limitation of Liability

Dog walking involves inherent risks. To the maximum extent permitted by law, GoWoofer shall not be liable for indirect, incidental, or consequential damages. The total liability of GoWoofer for any claim shall not exceed the greater of (a) the total fee paid for the applicable walk or (b) USD $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless GoWoofer Inc., its affiliates, officers, employees, agents, and contractors from any claims, damages, liabilities, or expenses (including reasonable attorney fees) arising from (a) your or your dog’s conduct, (b) your breach of these Terms, or (c) your violation of any law or third-party rights.

13. Force Majeure

GoWoofer is not liable for delays or failures caused by events beyond its reasonable control, including severe weather, technical outages, strikes, governmental restrictions, or natural disasters.

14. Dispute Resolution; Arbitration; Class Waiver

Before initiating arbitration, both parties shall attempt to resolve disputes informally through written notice and a 30-day cure period. Any unresolved dispute shall be settled by binding individual arbitration before JAMS in New York County, New York. You and GoWoofer waive the right to participate in class or representative proceedings. Judgment on an arbitration award may be entered in any competent court.

15. Governing Law & Venue

These Terms are governed by the laws of the State of New York, except for California residents whose rights are additionally protected under California consumer law. Venue for court actions shall be New York County, New York.

16. Privacy & Data Use

GoWoofer may collect and use personal and dog-related data, including GPS and photo data, under its Privacy Policy. California users have additional rights under the California Consumer Privacy Act (CCPA). Aggregated and anonymized data may be used for analytics and safety improvements.

17. Platform Content & IP

All content uploaded by users, including photos, reviews, and feedback, becomes the property of GoWoofer and may be used for safety, training, or promotional purposes in accordance with the Privacy Policy.

18. Modifications to Terms

GoWoofer may update these Terms periodically. Continued use of the Platform after notice of changes constitutes acceptance of the revised Terms.

19. Termination & Suspension

GoWoofer may suspend or terminate your account at any time for policy violations, safety issues, or fraud. Sections relating to liability, indemnification, and dispute resolution shall survive termination.

20. Miscellaneous

These Terms constitute the entire agreement between you and GoWoofer. If any provision is held invalid, the remainder remains enforceable. GoWoofer may assign this Agreement without notice. Failure to enforce any provision does not waive future enforcement rights. Notices to GoWoofer must be sent to the address above or to legal@gowoofer.com.
